Summary The impact of new technologies on the traditional law of legal acts is manifested at two levels: that of the negotium and that of the instrumentum. Online, it is a matter of directed and reflexive consent. The manifestation of the consent takes place by means of an offer and an acceptance on line. Determining the place and time of the meeting of the wills online is not easy. The new law of March 13, 2000 adapting the law of evidence to new information technologies recognizes that an electronic document has the same evidentiary value as a written document on paper, provided that it presents the same guarantees as the latter. The classical approach to the signature is abandoned to give way to a functional approach. The functions of the latter consist in identifying the person from whom the document emanates and in guaranteeing the integrity of this document.
